Vigilance Wing caters to Vigilance functions in respect of officers/officials posted in Department of Telecommunications and its sub-ordinate offices / DoT officers deputed to other Departments & Public Sector Undertakings (PSUs) / Board level executives in PSUs under DoT, viz, Bharat Sanchar Nigam Limited(BSNL), Mahanagar Telephone Nigam Limited (MTNL), Indian Telephone Industries Limited (ITI), Telecommunications Consultants India Limited (TCIL) , Bharat Broadband Network Limited (BBNL) and Autonomous body Centre for Development of Telematics (C-DOT). The cases related to above PSUs & other organizations under DoT are mainly processed through the Chief Vigilance Officers of the respective organizations.
The Vigilance Wing in Department of Telecommunications (DoT) is headed by a full time Chief Vigilance Officer (CVO) of the rank of Joint Secretary. The present CVO Shri Amitabh Gautam, is an officer of Indian Forest Service. He is assisted by Directors/Deputy Secretary and a group of vigilance officers/staff.

3. FUNCTIONS OF CHIEF VIGILANCE OFFICER (CVO)
The broad functions of Chief Vigilance Officer are:
- Scrutiny of complaints having vigilance angle.
- Direct investigation/inquiry of complaints having vigilance angle pertaining to Department of Telecommunications & various field offices of DoT.
- Investigation /enquiry of the complaints having vigilance angle through the vigilance units of the respective PSU/Autonomous bodies under the administrative control of the Department.
- Seeking advice from CVC on the cases having vigilance angle.
- Extend assistance/ liaison with CBI / Lokpal/ Police &other agencies in the investigation of cases.
- Examination of the self-contained notes/ SP’s reports received from CBI and its follow up.
- Handling of prosecution sanctions pertaining to Vigilance cases.
- Issues concerning suspension and other departmental action in vigilance matters.
- Conduct departmental/disciplinary proceedings in vigilance matters, in respect of all employees, including retired employees, having disciplinary authority in DoT.
- Coordination with CVC, UPSC, DoPT, CBI & other agencies on vigilance matters.
- Ratification of major penalties in respect of absorbed employees of BSNL.
- Handling and issue of orders in appeal, review and revision petitions relating to vigilance matters.
- Issue of vigilance clearance including CVC clearance.
- Preparation and maintenance of Agreed list, Officers of Doubtful Integrity (ODI) list and necessary action thereon.
- Coordination with the Chief Vigilance Officers of other organizations under DoT on vigilance matters.
- Conduct review meetings with the Chief Vigilance Officers of the PSUs /other organizations under the administrative control of the Department of Telecommunications on Vigilance matters.
- Identification of sensitive areas and monitoring implementation of rotational transfer policy.
- Scrutiny of Annual Property Returns & Intimation of acquisition/disposal of property submitted by the officers of the Department.
- Monitor Review exercise under FR-56(j) by respective Cadre Controlling Authorities in the Department and the PSUs under the Department
- Coordination for organizing training/workshop on vigilance matters.
- Observance of Vigilance Awareness Week.
4. FUNCTIONS OF VARIOUS SECTIONS OF VIGILANCE WING
Vigilance Monitoring Section under Director (VM)
- Scrutiny & investigation of complaints/cases having vigilance angle, monitoring and examination of investigation reports submitted by the Vigilance units of the respective PSU/ other organizations under the administrative control of the DoT viz. BSNL, MTNL, ITI, TCIL, C-DoT and BBNL.
- Consultation with Central Vigilance Commission (CVC) for seeking advice in respect of the officers under the jurisdiction of the CVC.
- Acceptance of CVC advice and issue of order for initiation of disciplinary proceedings or other departmental actions
- Establishment and administrative matters of Vigilance unit.
- MIS, Computerization & software development work pertaining to vigilance wing.
- Coordination with CVC/ DoP&T for appointment of Chief Vigilance officers in the PSUs under DoT & other matters on Vigilance.
- Submission of monthly report to the CVC in respect of disposal of complaints, imposition of penalty etc.
- Coordination for conducting monthly review meetings with CVOs of all PSUs of DoT.
Vigilance Technical Section under Director (V.Tech)
- Investigation of complaints assigned and providing technical comments on various investigations.
- Handling Parliament Questions related with Technical Aspects.
- Organizing events for observance of Vigilance Awareness Week.
- Seeking first stage advice of Central Vigilance Commission in respect of departmental Investigation report pertaining to officers not absorbed in PSUs.
- Annual Report of Vigilance Work of DoT.
- Scrutiny of Annual Immovable Property Returns of DoT officials.
- Periodical/surprise inspection of Vigilance to different of units/office of the department.
Vigilance - I Section under Director (Vigilance-I)
- Prosecution & Departmental vigilance cases referred by the CBI and other investigating agencies.
- Consultation with the Central Vigilance Commission on the above matter.
- Preparation of list of Officers of Doubtful Integrity (ODI) and Agreed List.
- Handling cases for suspension and periodical review.
- Handling cases for grant of vigilance clearance.
- Interaction/co-ordination with CBI & other investigating agencies.
Vigilance - II Section (Group A) under Director (VA)
- Conduct of departmental disciplinary proceedings in respect of all Group 'A' officers of the Department of Telecom from the issue of charge sheet till the finalization of the proceedings.
- Consultation with the Central Vigilance Commission on the above matter.
- Consultation with the Union Public Service Commission wherever penalty is to be imposed.
- Disciplinary cases under Rule -9 of CCS (Pension) Rules, 1972 for Group 'A' officers.
- Handling all court cases of Group 'A' arising from the departmental disciplinary proceedings.
- Disciplinary proceedings under Rule-19 of CCS (CCA) Rules 1965 in conviction cases.
- Consultation with DoPT wherever required.
Vigilance - II Section (Group B) under Deputy Secretary (VB)
- Disciplinary cases under Rule 14, 16 & 19 of CCS (CCA) Rules, 1965 in respect of Group B officials who are not absorbed in BSNL/ MTNL.
- Disciplinary cases under Rule 9 of CCS (Pension) Rules, 1972 in respect of retired Group B officials who are not absorbed in BSNL/ MTNL
- Seeking UPSC advice in case of Group B retired officials before issuance of Final Orders to them.
- Ratification of penalty imposed on the employees absorbed in BSNL/ MTNL.
- Court cases in vigilance matters pertaining to Group B, C & D employees including retired officials.
- Vigilance clearance matter in respect of Group B officials sought by Vigilance-I Section.
Vigilance III Section under Director (VP)
- Handling/examination and issuance of order in respect of Appeals, Revision Petitions, Review Petitions and Mercy Petitions of all the officials of DOT.
- Examination /issue of clarifications in the matters relating to disciplinary proceedings after obtaining views of DoP&T if necessary.
- Examination of matters relating to Building Works in all the disciplinary cases.
- Handling of departmental disciplinary proceedings in respect of all Group 'C' & 'D' officers of the Department of Telecom from the issue of charge sheet till the finalization of the proceedings.
5. VIGILANCE ANGLE
Vigilance angle is obvious in the following acts: -
- Demanding and/or accepting gratification other than legal remuneration in respect of an official act or for using his influence with any other official.
- Obtaining valuable thing, without consideration or with inadequate consideration from a person with whom he has or likely to have official dealings or his subordinates have official dealings or where he can exert influence.
- Obtaining for himself or for any other person any valuable thing or pecuniary advantage by corrupt or illegal means or by abusing his position as a public servant.
- Possession of assets disproportionate to his known sources of income.
- Cases of misappropriation, forgery or cheating or other similar criminal offences.

The complaints received from various sources are scrutinized and depending upon the merit and after ascertaining veracity of the complainant, the complaints are investigated. The complaints pertaining to the DoT and its units and involving Board level executives of the PSUs under DoT are investigated directly by the DoT Vigilance, whereas the complaints pertaining to the PSUs are got investigated through the Vigilance unit of the respective PSUs.
The Investigation Reports are examined and sent to CVC along with specific recommendations of the competent authority for seeking first stage advice for the cases involving officers under jurisdiction of CVC. Disciplinary proceedings against the officers are initiated after acceptance of the CVC advice by the competent authority. In the case of unabsorbed suspected public servants (SPSs), the regular disciplinary proceedings are conducted in DoT Vigilance, whereas in case of absorbed SPSs, the proceedings are initiated by the respective PSUs as per the extant conduct rules.
Public Grievances
1. Grievance Redressal Mechanism in Telecom Services Sector
(a) The primary responsibility of addressing the grievances related to service, billing, quality of service, etc. lies with Telecom Service Providers (TSPs), which emanates from licensing terms and conditions. As per licensing conditions
“Any dispute, with regard to the provision of SERVICE shall be a matter only between the aggrieved party and the LICENSEE, who shall duly notify this to all before providing the SERVICE and in no case the LICENSOR shall bear any liability or responsibility in the matter.”
(b) In order to streamline the process of grievance redressal mechanism by the service providers, TRAI has issued “Telecom Complaint Redressal Regulations 2012”. Which is available on TRAI website. According to this, all TSPs should set up a Two Tier grievance redressal mechanism. The highlights of this mechanism are -
(i) Establishment of a Complaint Centre: Every service provider shall, establish a Complaint Centre for redressal of complaints and for addressing service requests of its consumers. Complaint Centre is accessible to its consumers through a toll-free “Consumer Care Number”. Every service provider shall also, establish a ‘Web Based Complaint Monitoring System’ to enable the consumers to monitor the status of their complaints. Every Complaint Centre shall, immediately on receipt of a complaint from a consumer, register such complaint and allot a unique number to be called the docket number.
(ii) Establishment of an Appellate Authority: Every service provider shall, establish an Appellate Authority in each of its licensed service areas to dispose of the appeals filed. Where a consumer is not satisfied with the redressal of his complaint by the Complaint Centre, or his complaint remains unaddressed or no intimation of redressal of the complaint is received within the period specified, such consumer may prefer an appeal to the Appellate Authority of the concerned service provider for redressal of his complaint.
(c) Accordingly all complainants have to approach to their service providers for redressal of their grievances through “Two Tier Institutionalized Grievances Redressal Mechanism” of the concerned Service Provider established by it under Telecom Consumer Complaint Redressal Regulations, 2012 (1 of 2012) of TRAI issued on 05th January 2012 and amendments thereto.
2. Public Grievance Cell in DoT
(a) However, in case a grievance is not redressed even after exhausting the procedure as prescribed above, an individual complainant without prejudice to his right to approach an appropriate Court of Law, may approach Public Grievance Cell of Department of Telecommunications (DoT), along with all documentary evidence(s) for non-redressal of his grievance at concerned Service Provider level.
(b) Complainants are advised to use an online platform, Centralised Public Grievance Redress and Monitoring System (CPGRAMS) web portal http://www.pgportal.gov.in for registering their grievance. Any grievance sent by e-mail may not be attended to/entertained
(c) The status of the grievance filed in CPGRAMS can be tracked with the unique registration ID provided at the time of registration of the complainant. CPGRAMS also provides appeal facility to the citizens if they are not satisfied with the resolution by the Grievance Officer.
(d) Issues which are not considered as grievances :

- Religious matters
- Suggestions
- Grievances of Government employees concerning their service matters including disciplinary proceedings etc. unless the aggrieved employee has already exhausted the prescribed channels keeping in view the DoPT OM No. 11013/08/2013-Estt.(A-III) dated 31.08.2015.
(e) The complaint so registered is forwarded to the concerned service provider / subordinate organization(s) and / or to the concerned unit in DoT with an advice to take appropriate action in the matter and to inform the complainant regarding the action taken towards the redressal of grievance.
(f) The grievance is to be redressed by concerned service provider/ concerned forwarded organizations only. PG Cell of DoT acts only as a facilitator in the redressal process and is not vested with any powers to penalize the service provider for not redressing the grievance to the satisfaction of the complainant or for delay in redressing the grievance.

DOTEL/R/E/22/00955/1
1. As per the news story published in the news papers including Time of India dated 25.12.2022, some DoT officers are compulsory retired under Rule FR 56(J) and Rule 48 of CCS(Pension) Rules, 1972 (Copy attached). Provide details of the officers with their names, designations and place of posting.
2. Honorable Lokpal has passed order dated 14.11.2022 into my complaint against Mr Neeraj Agarwal, the then posted in Prasar Bharati on deputation as ADG AIR and DD Mumbai (Copy attached). Wherein Lokpal has passed directions in operative Para 20 of the order for various actions against him. Provide details of the action taken against him till date.
3. Mr Rajeev Singh, PGM, Finance, UP(W) Circle, BSNL, New Delhi who had resigned DoT (BSNL) and joined Prasar Bharati as Member(F) wef 09.04.2015 for a fix term of six years. His fix term had ended on 08.04.2021 (Copy attached). He had surrendered technical resignation from DoT (BSNL) which was duly accepted by the BSNL vide letter No. 1/4/2009/SEA-BSNL dated 23.04.2015. (1) Provide details of various retiral benefits paid to him after his resignation from DoT (BSNL) wef 23.04.2015. (2) Also provide date of his reinstatement in DoT(BSNL) after his end of term in Prasar Bharati as Member(F). (3) Also provide details of payments made to him after his reinstatement till date.

Satellite Services Division
About us:
The Satellite Division is entrusted with the role of coordinating all policy matters pertaining to SATCOM planning/operations/monitoring, introduction of new Satellite Technologies, Grant of satellite related licenses/ permissions, SATCOM network permissions and coordination etc.
Functional Structure:

This image shows the hierarchical structure of Satellite services. At the top of the diagram is a "Member," followed by the "Member DDG" role, with the "DDG Director" positioned beneath.
Broad Mandate & Functions:
a) SATCOM network permissions and coordination with Department of Space (DOS) on satellite policy related issues:
i. Granting in-principle approval of all satellite related networks involving new technology/ augmentation in existing networks by Inter Ministerial Committee for Satellite Network Clearance (IMCSNC). The committee examines the proposals for technical feasibility & compliance to TEC/ITU specifications. IMCSNC examines and clears proposals for new satellite network / type of satellite services including for VSAT, IFMC, UASL and NLD licenses.
This committee has members from DOS, Ministry of Information & Broadcasting (Mol&B), Wireless Planning & Coordination (WPC) and Network Operation & Control Center (NOCC). Satellite Division convenes the meetings and DDG (Satellite) chair the committee.
ii. Handling satellite-related subjects requiring specific knowledge & expertise; Representing DOT in SATCOM related committees in which DOS is the convener.
b) Grant of satellite related licenses/ permissions
Processing of applications, signing of License Agreement, Monitoring of VSAT services for their customer base, compliance to licensing conditions and technical requirements of TEC/ITU, issue of amendments, clarifications, merger & amalgamation cases, terms & conditions' violations cases and handling other related matters in respect of the following licenses:
i Commercial CUG VSAT service license
ii Captive CUG VSAT license
iii GMPCS license & Sui-Generis category license for provision & operation of satellite based services.
iv Satellite handset related matters.
c) Handling policy matters in DOT pertaining to SATCOM planning, operations & monitoring.
d) Coordinating for introduction of new Satellite Technologies & Systems.
e) Coordination pertaining to spectrum allocation, spectrum pricing & spectrum charging in respect of satellite services.
f) Assessing the satellite bandwidth demand for Satellite Communications.
g) Coordinating SATCOM bandwidth demand from 'Bharatnet', BSNL & other entities including USOF projects.
h) Participating in SATCOM related activities, relevant study group etc.
i) Handling subject matter(s) related to International Telecommunications Satellite Organization (ITSO), Intersputnik & International Mobile Satellite Organization (IMSO)
j) Remote area connectivity through SATCOM e.g. for A&N islands, Lakshadweep, North Eastern region etc.

Policy and Guidelines
A. How to Apply for Satellite related license(s)
1. Presently, the authorisations under Unified License that pertain directly to the satellite-related services are:
a) Commercial VSAT CUG
b) Global Mobile Personal Communication by Satellite (GMPCS).
2. The Applicant companies desirous of getting an Authorization under Unified License may refer to the detailed guidelines of Unified License available vide letter No. 20-577/2016-AS-I (Vol III) dated 17.01.2022
3. The applicant companies may submit the application form online on SARAL (Simplified Application for Registration and Licenses) SANCHAR Portal in the prescribed format. For ease of understanding, an illustration for indicative purpose has also been provided as appendix in the following table:

B. Apply for Captive VSAT CUG Network License
The applicant must be an Indian company registered under the Indian Companies Act, 1956/Government department/ Government organizations. The total composite foreign holding of the registered company shall be governed by Foreign Direct Investment (FDI) policy of the Government of India as announced by Department of Industrial Policy and Promotion from time to time. For complete details about terms and conditions of the license agreement, the applicants are advised to refer to a draft Captive VSAT CUG license document available on (link) and www.saralsanchar.gov.in.

- Exact locations of Hub/central site and tentative locations of other earth stations/ VSATs
Captive VSAT CUG License is applicable to install a VSAT - small-sized earth station used in the transmit/ receive of data, voice, and video signals over a satellite communication network, excluding broadcast television, for personal use, in remote and inaccessible locations (rural areas, ships, coastal regions, hills, etc) where there is limited or no terrestrial connectivity.
C. Apply for In-flight and Maritime Connectivity (IFMC) Service Authorization
A company can obtain IFMC Authorization to provide wireless voice or data or both type of telegraph messages on ships within Indian territorial waters and on aircraft within or above India or Indian territorial waters. The IFMC Service Provider so authorised may provide such services in geographical areas such as Exclusive Economic Zones (EEZ), High Seas, etc. in accordance with the rights granted to State under the international laws.
Eligibility:
(a) Applicant holds a license for access service or an ISP category A license; and
(b) holds an NLD license or a Commercial VSAT CUG service license, and has satellite gateway earth station within the service area of the license as specified in clause (a), in case connectivity through satellite is used.
(c) any Indian airlines company or foreign airlines company having permission to enter Indian airspace by the Directorate General of Civil Aviation;
(d) any Indian shipping company or foreign shipping company whose vessels or ships call Indian ports or transit Indian territorial waters and intend to carry out communication for non-GMDSS (Global Maritime Distress and Safety System) [routine] or for commercial purpose; and
(e) any company incorporated under the Companies Act, 2013 (18 of 2013) or under any previous company law.
