1.  ABOUT US

Vigilance Wing caters to Vigilance functions in respect of officers/officials posted in Department of Telecommunications and its sub-ordinate offices / DoT officers deputed to other Departments & Public Sector Undertakings (PSUs) / Board level executives in PSUs under DoT, viz, Bharat Sanchar Nigam Limited(BSNL), Mahanagar Telephone Nigam Limited (MTNL), Indian Telephone Industries Limited (ITI), Telecommunications Consultants India Limited (TCIL) , Bharat Broadband Network Limited (BBNL) and Autonomous body Centre for Development of Telematics (C-DOT). The cases related to above PSUs & other organizations under DoT are mainly processed through the Chief Vigilance Officers of the respective organizations.

The Vigilance Wing in Department of Telecommunications (DoT) is headed by a full time Chief Vigilance Officer (CVO) of the rank of Joint Secretary. The present CVO Shri Amitabh Gautam, is an officer of Indian Forest Service. He is assisted by Directors/Deputy Secretary and a group of vigilance officers/staff.

3.  FUNCTIONS OF CHIEF VIGILANCE OFFICER (CVO)

The Vigilance Unit of the Department of Telecommunications is responsible for vigilance activities in the organization under the general superintendence of the Central Vigilance Commission (CVC), the apex organization of the Government of India that controls anti-corruption measures and probity in public life. The vigilance unit is headed by a Chief Vigilance Officer of Joint Secretary level, who is assisted by Director/DS level officers and other group of officers for conduct of investigations, disciplinary proceedings and other follow-up actions.

5.  VIGILANCE ANGLE

Vigilance angle is obvious in the following acts: -

  1. Demanding and/or accepting gratification other than legal remuneration in respect of an official act or for using his influence with any other official.
  2. Obtaining valuable thing, without consideration or with inadequate consideration from a person with whom he has or likely to have official dealings or his subordinates have official dealings or where he can exert influence.
  3. Obtaining for himself or for any other person any valuable thing or pecuniary advantage by corrupt or illegal means or by abusing his position as a public servant.
  4. Possession of assets disproportionate to his known sources of income.
  5. Cases of misappropriation, forgery or cheating or other similar criminal offences.

2(a)There are, however, other irregularities where circumstances will have to be weighed carefully to take a view whether the officer’s integrity is in doubt. Gross or Wilful negligence; recklessness in decision making; blatant violations of systems and procedures; exercise of discretion in excess, where no ostensible/public interest is evident; failure to keep the controlling authority/superiors informed in time – these are some of the irregularities where the disciplinary authority with the help of the CVO should carefully study the case and weigh the circumstances to come to a conclusion whether there is reasonable ground to doubt the integrity of the officer concerned.

2(b) Any undue/unjustified delay in the disposal of a case, perceived after considering all relevant factors, would reinforce a conclusion as to the presence of vigilance angle in a case.

3.The raison d'être of vigilance activity is not to reduce but to enhance the level of managerial efficiency and effectiveness in the organization. Commercial risk taking forms part of business. Therefore, every loss caused to the organization, either in pecuniary or non-pecuniary terms, need not necessarily become the subject matter of a vigilance inquiry. Thus, whether a person of common prudence, working within the ambit of the prescribed rules, regulations and instructions, would have taken the decision in the prevailing circumstances in the commercial/operational interests of the organization is one possible criterion for determining the bona fides of the case. A positive response to this question may indicate the existence of bona- fides. A negative reply, on the other hand, might indicate their absence.

4.Absence of vigilance angle in various acts of omission and commission does not mean that the concerned official is not liable to face the consequences of his actions. All such lapses not attracting vigilance angle would, indeed, have to be dealt with appropriately as per the disciplinary procedure under the service rules.

6.  HOW TO LODGE A COMPLAINT

Information about corruption, malpractices, cheating, misconduct on the part of any employee/officer of Department of Telecommunications (DoT) or any activity causing financial/wrongful loss to DoT can be reported to:

Note : Anonymous and Pseudonymous complaints are not entertained as the complainants who do not want to disclose their identity may make complaints under ‘Public Interest Disclosure & Protection of Informers’ Resolution 2004 (PIDPI).

7.  COMPLAINT HANDLING

The complaints received from various sources are scrutinized and depending upon the merit and after ascertaining veracity of the complainant, the complaints are investigated. The complaints pertaining to the DoT and its units and involving Board level executives of the PSUs under DoT are investigated directly by the DoT Vigilance, whereas the complaints pertaining to the PSUs are got investigated through the Vigilance unit of the respective PSUs.

The Investigation Reports are examined and sent to CVC along with specific recommendations of the competent authority for seeking first stage advice for the cases involving officers under jurisdiction of CVC. Disciplinary proceedings against the officers are initiated after acceptance of the CVC advice by the competent authority. In the case of unabsorbed suspected public servants (SPSs), the regular disciplinary proceedings are conducted in DoT Vigilance, whereas in case of absorbed SPSs, the proceedings are initiated by the respective PSUs as per the extant conduct rules.

1. Grievance Redressal Mechanism in Telecom Services Sector

(a) The primary responsibility of addressing the grievances related to service, billing, quality of service, etc. lies with Telecom Service Providers (TSPs), which emanates from licensing terms and conditions. As per licensing conditions

            “Any dispute, with regard to the provision of SERVICE shall be a matter only between the aggrieved party and the LICENSEE, who shall duly notify this to all before providing the SERVICE and in no case the LICENSOR shall bear any liability or responsibility in the matter.”

 (b) In order to streamline the process of grievance redressal mechanism by the service providers, TRAI has issued “Telecom Complaint Redressal Regulations 2012”. Which is available on TRAI website. According to this, all TSPs should set up a Two Tier grievance redressal mechanism. The highlights of this mechanism are -

      (i)  Establishment of a Complaint Centre: Every service provider shall, establish a Complaint Centre for redressal of complaints and for addressing service requests of its consumers. Complaint Centre is accessible to its consumers through a toll-free “Consumer Care Number”. Every service provider shall also, establish a ‘Web Based Complaint Monitoring System’ to enable the consumers to monitor the status of their complaints. Every Complaint Centre shall, immediately on receipt of a complaint from a consumer, register such complaint and allot a unique number to be called the docket number.

     (ii)   Establishment of an Appellate Authority: Every service provider shall, establish an Appellate Authority in each of its licensed service areas to dispose of the appeals filed. Where a consumer is not satisfied with the redressal of his complaint by the Complaint Centre, or his complaint remains unaddressed or no intimation of redressal of the complaint is received within the period specified, such consumer may prefer an appeal to the Appellate Authority of the concerned service provider for redressal of his complaint.

(c) Accordingly all complainants have to approach to their service providers for redressal of their grievances through “Two Tier Institutionalized Grievances Redressal Mechanism” of the concerned Service Provider established by it under Telecom Consumer Complaint Redressal Regulations, 2012 (1 of 2012) of TRAI issued on 05th January 2012 and amendments thereto.

 

2. Public Grievance Cell in DoT

(a)    However, in case a grievance is not redressed even after exhausting the procedure as prescribed above, an individual complainant without prejudice to his right to approach an appropriate Court of Law, may approach Public Grievance Cell of Department of Telecommunications (DoT), along with all documentary evidence(s) for non-redressal of his grievance at concerned Service Provider level.

(b)  Complainants are advised to use an online platform, Centralised Public Grievance Redress and Monitoring System (CPGRAMS) web portal http://www.pgportal.gov.in for registering their grievance. Any grievance sent by e-mail may not be attended to/entertained

(c)   The status of the grievance filed in CPGRAMS can be tracked with the unique registration ID provided at the time of registration of the complainant. CPGRAMS also provides appeal facility to the citizens if they are not satisfied with the resolution by the Grievance Officer.

(d)   Issues which are not considered as grievances :

  • RTI Matters
  • Court related / Sub-judice matters
  • Religious matters
  • Suggestions
  • Grievances of Government employees concerning their service matters including disciplinary proceedings etc. unless the aggrieved employee has already exhausted the prescribed channels keeping in view the DoPT OM No. 11013/08/2013-Estt.(A-III) dated 31.08.2015.

  (e)  The complaint so registered is forwarded to the concerned service  provider / subordinate organization(s) and / or to the concerned unit in DoT with an advice to take appropriate action in the matter and to inform the complainant regarding the action taken towards the redressal of grievance.

  (f)   The grievance is to be redressed by concerned service provider/ concerned forwarded organizations only. PG Cell of DoT acts only as a facilitator in the redressal process and is not vested with any powers to penalize the service provider for not redressing the grievance to the satisfaction of the complainant or for delay in redressing the grievance.

His fix term had ended on 08.04.2021 (Copy attached). He had surrendered technical resignation from DoT (BSNL) which was duly accepted by the BSNL vide letter No. 1/4/2009/SEA-BSNL dated 23.04.2015. (1) Provide details of various retiral benefits paid to him after his resignation from DoT (BSNL) wef 23.04.2015. Programmes to advance understanding of RTI   (Section 26)

Workshops/Trainings/programmes/webinars, as and when conducted, are regularly attended by CPIO or other officers/officials of the Department.

(ii) Efforts to encourage public authority to participate in these programmes

All CPIOs and support staff are regularly encouraged to participate in such educational programmes and their participation is also monitored.

Training of CPIO/APIO is done through the training programmes organized by NICF, NTIRIT, ISTM and other such institutes.

When CPIO called me for inspection on 5.7.2017, the file shown was not relevant to the issue raised by me. Another inspection was allowed today when the relevant file was produced but portion relating to original copy of my letter dated 27.10.2017 and action taken thereon could not be produced by the concerned officer. It seems that my letter dated was either not processed at all (I have not received any response till date) or it was kept pending on account of acts of misdemeanors committed by the then Director(Staff) & DDG(Establishment) as indicated in my letter. Nevertheless, I request for disclosure of my letter dated 27.12.2010 and action taken thereon. Your kind intervention is requested.

About us:

The Satellite Division is entrusted with the role of coordinating all policy matters pertaining to SATCOM planning/operations/monitoring, introduction of new Satellite Technologies, Grant of satellite related licenses/ permissions, SATCOM network permissions and coordination etc.

Functional Structure:

Broad Mandate & Functions:

a)    SATCOM network permissions and coordination with Department of Space (DOS) on satellite policy related issues:

i.    Granting in-principle approval of all satellite related networks involving new technology/ augmentation in existing networks by Inter Ministerial Committee for Satellite Network Clearance (IMCSNC). The committee examines the proposals for technical feasibility & compliance to TEC/ITU specifications. IMCSNC examines and clears proposals for new satellite network / type of satellite services including for VSAT, IFMC, UASL and NLD licenses.

This committee has members from DOS, Ministry of Information & Broadcasting (Mol&B), Wireless Planning & Coordination (WPC) and Network Operation & Control Center (NOCC). Satellite Division convenes the meetings and DDG (Satellite) chair the committee.

ii.    Handling satellite-related subjects requiring specific knowledge & expertise; Representing DOT in SATCOM related committees in which DOS is the convener.

b)    Grant of satellite related licenses/ permissions

Processing of applications, signing of License Agreement, Monitoring of VSAT services for their customer base, compliance to licensing conditions and technical requirements of TEC/ITU, issue of amendments, clarifications, merger & amalgamation cases, terms & conditions' violations cases and handling other related matters in respect of the following licenses:
i    Commercial CUG VSAT service license 
ii    Captive CUG VSAT license 
iii    GMPCS license & Sui-Generis category license for provision & operation of satellite based services.
iv    Satellite handset related matters.

c)    Handling policy matters in DOT pertaining to SATCOM planning, operations &  monitoring.
d)    Coordinating for introduction of new Satellite Technologies & Systems.
e)    Coordination pertaining to spectrum allocation, spectrum pricing & spectrum charging in respect of satellite services.
f)    Assessing the satellite bandwidth demand for Satellite Communications.
g)    Coordinating SATCOM bandwidth demand from 'Bharatnet', BSNL & other entities including USOF projects.
h)    Participating in SATCOM related activities, relevant study group etc.
i)    Handling subject matter(s) related to International Telecommunications Satellite Organization (ITSO), Intersputnik & International Mobile Satellite Organization (IMSO)
j)    Remote area connectivity through SATCOM e.g. for A&N islands, Lakshadweep, North Eastern region etc.
k)    Coordination in DOT regarding NavIC Navigation with Indian Constellation through Indian Regional Navigation Satellite System (IRNSS)
l)    Coordinating with TEC on Interface Requirements for Satellite Systems and other SATCOM related matters.
m)    Handle all related matters like court-cases, PQs, coordination with other departments /organizations pertaining to the subjects mentioned above.
n)    All works related to Green Telecom/Sustainable telecommunications including the framing of new green telecommunication guidelines/policies.
 

Policy and Guidelines

 

A. How to Apply for Satellite related license(s)

1. Presently, the authorisations under Unified License that pertain directly to the satellite-related services are:

a) Commercial VSAT CUG

b) Global Mobile Personal Communication by Satellite (GMPCS).

2. The Applicant companies desirous of getting an Authorization under Unified License may refer to the detailed guidelines of Unified License available vide letter No. 20-577/2016-AS-I (Vol III) dated 17.01.2022

3. The applicant companies may submit the application form online on SARAL (Simplified Application for Registration and Licenses) SANCHAR Portal in the prescribed format. For ease of understanding, an illustration for indicative  purpose has also been provided as appendix in the following table:

Original Power of Attorney by resolution of board of Directors that the person signing the application is authorized signatory on stamp paper

(a)     The Power of Attorney in favour of authorized signatory on a non-judicial stamp paper of Rs.100/-. To be given through Board Resolution. To be signed by a person other than in whose favour it is being given. It should bear the seal of the company. It should be notarized. It should have specimen signature of Authorized signatory.

(b)     A separate Board Resolution on company letterhead duly signed by board of Directors is also to be submitted.

Details of Promoters/Partners/shareholder in the company

To be submitted on company letterhead and signed by Authorized Signatory as per para 7(a) of the application Form. Complete break up of 100% equity to be submitted. In case another company is having some shareholding in the applicant company, then complete breakup of shareholding of that company upto the ultimate beneficiaries also to be given.

Further a diagrammatic representation of the flow of funds starting from the applicant and tracing back to the ultimate beneficiary need to be submitted.

Board resolution regarding appointment of statutory auditor along with specimen signature of CA

B. Apply for Captive VSAT CUG Network License

The applicant must be an Indian company registered under the Indian Companies Act, 1956/Government department/ Government organizations. The total composite foreign holding of the registered company shall be governed by Foreign Direct Investment (FDI) policy of the Government of India as announced by Department of Industrial Policy and Promotion from time to time. For complete details about terms and conditions of the license agreement, the applicants are advised to refer to a draft Captive VSAT CUG license document available on (link) and www.saralsanchar.gov.in.

  11. Carrier Power & Bandwidth summary showing total space segment & satellite power requirements
  12. Clause-by-clause compliance to applicable TEC GR/ IR [TEC IR No.42012:2022]
  13. List of model & make of all the equipment proposed in the network along with their specifications/data sheets
  14. Exact locations of Hub/central site and tentative locations of other earth stations/ VSATs

 

Captive VSAT CUG License is applicable to install a VSAT - small-sized earth station used in the transmit/ receive of data, voice, and video signals over a satellite communication network, excluding broadcast television, for personal use, in remote and inaccessible locations (rural areas, ships, coastal regions, hills, etc) where there is limited or no terrestrial connectivity.

 

C. Apply for In-flight and Maritime Connectivity (IFMC) Service Authorization

A company can obtain IFMC Authorization to provide wireless voice or data or both type of telegraph messages on ships within Indian territorial waters and on aircraft within or above India or Indian territorial waters. The IFMC Service Provider so authorised may provide such services in geographical areas such as Exclusive Economic Zones (EEZ), High Seas, etc. in accordance with the rights granted to State under the international laws.

Eligibility:

(a) Applicant holds a license for access service or an ISP category A license; and

(b) holds an NLD license or a Commercial VSAT CUG service license, and has satellite gateway earth station within the service area of the license as specified in clause (a), in case connectivity through satellite is used.

(c) any Indian airlines company or foreign airlines company having permission to enter Indian airspace by the Directorate General of Civil Aviation;

(d) any Indian shipping company or foreign shipping company whose vessels or ships call Indian ports or transit Indian territorial waters and intend to carry out communication for non-GMDSS (Global Maritime Distress and Safety System) [routine] or for commercial purpose; and

(e) any company incorporated under the Companies Act, 2013 (18 of 2013) or under any previous company law.

The CPIO has deliberately provided incomplete information. The present appeal is being preferred on the following grounds: (a) The CPIO has not provided point-wise reply to the information requested. Instead, the CPIO erroneously provided a copy the gazette notification containing Telecom Suspension Rules, 2017. (b) Queries 1 & 2: The Appellant had sought the copy of a recent directive issued by the DoT to all State and UT Governments to advice caution against suspending internet service. A copy of recent news report was annexed to the RTI application for easy reference. The CPIO, however, did not provide a copy of directive or denied the existence of such directive. (c) Queries 3 & 4: The Appellant had sought the copy of a recent directive issued by the DoT to various District Magistrates to advice caution against suspending internet service. The CPIO, however, did not provide a copy of directive or denied the existence of such directive.
