    Work allocation under DDG(Licensing Finance Policy) Division

    Director (LFP-I):

    1. Dealing with legal disputes and court cases in respect of interpretation of financial conditions of license agreement before the following legal fora:
      1. Hon’ble Supreme Court of India
      2. High Courts
      3. NCLT and NCLAT
      4. TDSAT
      5. Any other Court / Tribunal
    2. Nodal Unit for all insolvency related matters of licensees.

     

    Director (LFP-II):
     

    1. Dealing with Policy matters relating to:
      1. Terms and Conditions of License Agreements
      2. Interpretation of the License Agreements
      3. Grant of LoI, Licenses, authorizations, registrations
      4. Merger and Acquisitions of licensees
      5. Surrender and Termination of Licenses
      6. Tripartite Agreements related to licensees
      7. Other Misc. Policy issues / clarifications
    2. Interpretation and implementation of financial conditions of the license agreements towards effective realization of revenue & related policy issues including new policy initiatives, license amendment, wherever required, etc.
    3. Examining TRAI recommendations related with the licensing finance issues including the considerations within the Contracts / License Agreements under Indian Telegraph Act, 1885 involving issues such as Bank Guarantee, License Fee, Spectrum Usage Charges, etc.
    4. Monitoring and Co-ordination with CGCA and Pr. CCA / CCA offices in respect of following matters:  
      1. Issuing of clarifications regarding assessment of License Fee and Bank Guarantee management
      2. Any other issue related to the License Agreement to be dealt by the Pr. CCA / CCA offices, etc.
    5. Scrutiny of files related to levy of penalty under license agreement.
    6. Scrutiny of files related to fulfilment of rollout obligations and imposition of Liquidated Damages (LDs) on non-fulfilment of roll-out obligations
    7. Scrutiny of files related to Policy matters on subscriber verification, MNP, EMF testing fees, etc.
    8. Inter-ministerial coordination in respect of licensing finance issues.
    9. Parliament questions, RTI Cases, PG Cases, VIP References, Audit related issues related to Licensing finance matters
