I, Amit Sharma S/o Shri Kewal Krishan Sharma, i.e. RTI Applicant herein earnestly requesting the Honble CPIO DOT to kindly facilitate him (the applicant) on this RTI Application by providing information pointwise. Also, the RTI Applicant would like to request the Honble CPIO to please supply information in necessary coordination and consultation with concerned departments under Section 6(3) of RTI and as per the Department of Telecommunication (DOT) Guidelines, Standards, Instructions, and Procedures on the documents and records.
REQUESTING YOUR HONOR TO KINDLY BE GRACIOUS ENOUGH TO PROVIDE INFORMATION POINT WISE AS SOUGHT BY THE RTI APPLICANT:
1.Please supply a copy of the procedure, guideline, and/or Act according to which DOT is empowered to get call data records (CDRs) from Telecom Service Provider.
2.Please supply a copy of detailed instructions and standard operating procedures (SOPs) issued in August 2016 and April 2019 for providing call data records (CDRs) to law enforcement agencies.
3.The license condition goes on to mandate that call data records (CDRs) be provided by mobile companies to the law enforcement agencies and to various courts upon their specific requests or directions, for which there is a laid-down protocol. Please provide a copy of the laid-down protocol to the RTI Applicant under RTI Act 2005 as sought by the Applicant in the Point 2 of this RTI.
4.According to DOT procedure, instructions, and SOPs who all are authorized to get call data records (CDRs). Please supply a list of such authorized departments and designation who can get CDRs of the individual(s).
6.DOES the INFORMATION SOUGHT FALL UNDER SECTION 8: I, Amit Sharma S/o Shri Kewal Krishan Sharma, the RTI Applicant hope that the concerned CPIO may be gracious enough and be kind to provide information as sought by the RTI Application under the RTI Act 2005 for which the RTI Applicant state that the information sought by him does not fall within the exemptions contained in Section 8 of the Right to Information Act, 2005 and to the best of my knowledge it pertains to the concerned CPIO office.
