Respected Sir,
1. It is learnt that DoT has issued a clarification dated 24/03/2003 in File No. ..(not clear) /2002 Pen(T) in the subject of clarification regarding payment of pensionary benefits to a retiree against whom personal court cases (other than department) is pending in the competent court
2. It is understood that this clarification has been issued on the advice of Department of Pension & PW vide their No. 17729/03 P&PW(F) dated 10/03/2003.
3. Both the Circulars / clarifications are not available in the websites of the departments and they are essential for disposal of certain cases pertaining to central government employees who are governed by CCS(Pension) Rules, 1972.
4. In view of the above, I request your kind authority to furnish the above said orders/circulars under RTI Act please.

Apeal Reply

I have carefully considered the grounds of appeal and the action taken by the Dir (Estt.II) & CPIO against the said RTI application. I find the action taken by the Dir(Estt.II) & CPIO w.r.t. to the said RTI application to be in order in terms of the provisions contained in the RTI Act, 2005. Further as requested by the applicant, a copy of the relevant order as stated in the reply dated 5.4.2018 of the CPIO is enclosed herewith. The appeal preferred by Shri Nagendra Prasad Sista stands disposed of accordingly.
