Request for Information under RTI Act, 2005
I, Smt. Manjulaben N Dave, aged 71 years, residing at the above address, wants to seek the following information under RTI Act, 2005.
I am a legitimate claimant of benefits conveyed by the DoE, MoF, GOI, in their OM F.No.1/1/2008/IC dated 13.11.2009. Since the effective implementation of the said OM was denied to pre-2006 pensioners. Some pre-2006 pensioners of erstwhile DoT-Bengalore approached Honourable CAT-Bengalore Bench and obtained a favourable verdict in OA No.231/2012 and CP No237/2015, on the basis of acceptance furnished by the Respondent agreeing to implement and extend the benefits of the up gradation of grade pay Rs.4600/- contained in the same OM dated 13.11.20009 to pre-2006 pensioners. This was contained in letter No.12/Legal(38)/CP 237/2015 dated 10.04.2017 from Dy. CCA (Legal), CCA, Karnataka Circle, Bengaluru addressed to Director (E), DoT, Sanchar Bhavan, New Delhi, which is furnished in CAT-Bengalore Bench on 12.04.2017.( PDF attached for ready reference)
My queries are as under:
1. DoT vide their letter No.38-51/2012-PEN(T) dated 22.3.2017 approval was conveyed to implement the orders of Honourable CAT in toto. Is DoT extending the benefits up gradation of the grade pay Rs.4600/- to similarly placed pre-2006 pensioners also who have not approached CAT/Court. Please furnish me the certified copy of the captioned letter dated 22.3.2017.
2. CCA, DoT, Karnataka Circle, Bengaluru vide letter dated 15.3.2017 seek out from DoT, Sanchar Bhavan, New Delhi that manner in which the orders in present CP 237/2015 and 21/2016 is to be implemented as there are three alternatives. Please furnish me the certified copy of the captioned letter dated 15.3.2017.
3. It was submitted in letter dated 10.4.2017 that matter was referred to Counsels in above both CPs for giving their considered opinion. A copy of the letter sent to both the Counsels and opinion received from both the Counsels were attached to said letter dated 10.04.2017. Please furnish me the certified copy of letter addressed to both the Counsels of CPs and opinion received from both the Counsels.
4. Copy of captioned letter dated 10.4,2017 was endorsed to Additional Secretary, DoP&PW, New Delhi with reference to their DO letter No.38/33/12-P&PW(A) dated 02.03.2017. Please furnish me the certified copy of the said DO letter dated 02.03.2017.
5. I want to know that what type of communication received from DoE, MoF, New Delhi in respect of above both 2 CPs which prompted to endorsed the copy of letter dated 10.4.2017 to them too. Please furnish me the certified copy of the communication received from Shri Vivek Ashish, Under Secretary, E. V Branch, DoE, MoF, New Delhi.
